Fusione Wind e 3 Italia, ci saranno dei rimborsi dopo l’ultima sentenza?

Da alcuni giorni a questa parte si parla con insistenza della fusione Wind e 3 Italia e di come si svilupperà la vicenda del roaming internazionale, proposto dai due operatori a tariffe fuori mercato. Ebbene, in questi giorni è giunta proprio per questi motivi una sentenza che obbliga i due brand a pagare una multa di oltre 250mila euro.

A seguire, per mettere a fuoco al meglio la situazione, possiamo riportarvi quanto trapelato dalla sentenza che ha fatto molto discutere di recente, anche nell’ottica della fusione Wind e 3 Italia:

“Per quanto concerne la trasparenza e la completezza delle informative rese in merito alle novità introdotte in ambito comunitario, la Società [sia Wind sia Tre, ndr] ha omesso di fornire indicazioni esaurienti circa le condizioni giuridiche ed economiche delle tariffe applicate in Unione europea, impedendo agli utenti di compiere scelte contrattuali consapevoli ed economicamente appropriate alle proprie esigenze e non adottando, al contempo, misure di tutela efficaci al fine di compensare gli utenti per gli illegittimi addebiti ricevuti. In considerazione, infine, della vasta platea di utenti coinvolti e del ricavo realizzato dalla Società per i servizi roaming nell’intervallo temporale compreso tra il 1 aprile ed il 30 settembre 2016, la violazione può ritenersi di entità consistente, sotto il profilo del danno cagionato agli utenti, e di durata prolungata”.

Insomma, dal punto di vista giudiziario, non nasce sotto mi migliori auspici la tanto chiacchierata fusione Wind e 3 Italia, fermo restando che agli utenti dei due operatori non spetta alcun rimborso.
