Ebbene si, il Procuratore Generale di New York, Mr. Andrew M. Cuomo, ha deciso di impiantare un procedimento penale nei confronti del social network Tagged.com. Il sito di scambio amicizia, è secondo le voci, colpevole di avere invaso la privacy delle persone iscritte al servizio, essendosi procurato in maniera non del tutto legale e fraudolenta le rubriche dei contatti personali degli iscritti, utilizzando poi questo enorme database di indirizzi per avviare la propria campagna di spam per l’iscrizione al sito.
Ma le accuse non finiscono qui. Infatti, Tagged.com non è solo accusato di utilizzo di spam partendo dalle e-mail dei propri utenti registrati, ma secondo la Procura Generale di New York, ma che avrebbe camuffato il mittente dell’invio della e-mail con l’amico dal quale è stato preso l’indirizzo. Questa operazione aveva inoltre una backdoor. Chiunque cliccava sulla foto del contatto per la visualizzazione delle foto, veniva immesso in una pagina di registrazione “obbligatoria” di iscrizione. Il procuratore Cuomo, ha dichiarato in base a questa situazione che: “Questa azienda ha rubato le rubriche e le identità di milioni di persone, i consumatori hanno visto invadere la propria privacy e sono stati spinti nell’imbarazzante situazione di dover chiedere scusa a tutti i loro contatti via posta per il comportamento immorale, e illegale, di Tagged. Questa forma estremamente virulenta di spam è l’equivalente telematico del penetrare in una casa, rubare la rubrica degli indirizzi e spedire missive false a tutti i contatti personali degli individui. Una cosa che noi non accetteremmo mai nel mondo reale“.
Con queste parole, il Procuratore intende che la frode telematica in questo caso non deve essere messa in secondo piano rispetto a quella reale. Di conseguenza, la Procura Generale richiederà al social network Tagged.com di interrompere immediatamente le proprie pratiche fraudolente, ma soprattutto di pagare una multa che sia di compenso per i 60 milioni di e-mail che sono state inviate nel mondo.
Il CEO del sito, Greg Tseng, ha però dichiarato che non è stata fatta alcuna azione illecita, ma che la pratica è avvenuta a seguito di “errori di comunicazione” avvenuti nel processo di registrazione.
