A volte pur di farsi protagonisti della realtà, o ancor peggio di una cronaca si è disposti a farsi riprendere in video a fare le cose più assurde o nelle situazioni più particolari pur di finire on line. E’ il caso di molti personaggi presenti nella rete sul social network video di YouTube. Qui, tanti video amatori armati di cellulare con fotocamera o ancora di una piccola Handy Cam, si trasformano in registi o ancor meglio in foto reporter di eccezione per riprendere l’accaduto. Può però capitare che il soggetto interessato, non sia disposto a farsi riprendere in video. Se si trattasse di una ripresa televisiva, come avviene in questo ambito al protagonista del video (vedi le candid camera), viene fatta firmare una liberatoria che da il consenso alla trasmissione in televisione, ma per Internet? Su Internet ed in particolare per i siti come YouTube, questo tipo di tutela non esiste e per questa motivazione, molte sono le cause legali impiantate contro i divulgatori di video senza autorizzazione. Non si tratta di una caso molto frequente in Italia, ma è una mania che in Paesi come Germania e Francia sta andando molto: quella di fare causa a chi ha pubblicato video con persone estranee che fanno da protagonisti. Giustamente il sito di social networking per la diffusione dei video, è tutelato dal canto suo. Infatti alla pubblicazione di un nuovo video sul sito internet ritroviamo la solita casellina da spuntare del tipo “Dichiaro di essere proprietario e/o di avere i diritti per pubblicare il video…”. Gli utenti spuntano la V su questa casellina ormai come fosse una cosa automatica senza dare più peso al valore legale che deve essere dato a quella avvertenza. Caso a parte, invece è stato dichiarato quello del nuovo network di video sharing che è nato in California di nome Reporters’ Center. Questo, a differenza di YouTube, non cerca l’imposizione del caricare video assumendosene i diritti, ma semplicemente accetta i video solo in caso in cui si tratti di un video dal contenuto che può essere definito “video giornalistico”. You Tube, nella persona di Olivia Ma, News Manager del sito, ha confermato però che a breve sarà inserita una nuova risorsa, dedicata al Citizen News. Questa notizia si è già vista su un suo post dell’anno scorso, ma non ha avuto ancora attuazione. Staremo a vedere cosa avverrà…
