Facebook vince contro il cybersquatting

Altra discordia legale per Facebook e nuova vittoria in Tribunale per lo stesso. Sembra che al giorno d’oggi il colosso dei social network Facebook, non abbia più timore di arrivare in Tribunale per fare cause legali, visto che si sente vincitore già in anticipo. La causa è nata proprio nel nostro Paese, dove al sito era stata tolta l’assegnazione del dominio .it. In effetti, una vera e propria causa non è mai esistita anche perchè Facebook ha avuto la meglio data l’impossibilità di contattare la controparte, riuscendo ad ottenere quindi una rapida soluzione senza conseguenze. In pratica Facebook sarà disponibile on line cliccando semplicemente su www.facebook.it.
La decisione comunicata dal sito del Centro risoluzione disputi domini (Crdd) ufficialmente, ha scritto che: “Con ricorso ricevuto per e-mail da CRDD in data 15 aprile 2009 la società Facebook UK Ltd, in persona del legale rappresentante, sig. Cipora Herman, rappresentata nella presente procedura dall’avv. Fabrizio Jacobacci e dal dott. Massimo Introvigne, introduceva una procedura di riassegnazione, ai sensi dell’art. 3.1 del Regolamento per la risoluzione delle dispute nel ccTLD “it” (d’ora in poi Regolamento) e dell’art. 5.6 del Regolamento per l’assegnazione e la gestione dei nomi a dominio nel ccTLD “it”, per ottenere il trasferimento in suo favore del nome a dominio facebook.it, registrato dal sig. John Michael Preston“.
La causa è terminata con la vittoria del “nostro” social network secondo tre evidenze che sarebbero risultate note a seguito delle indagini effettuate dalla Magistratura e dalla Polizia Postale. Nello specifico si evince dal documento che la decisione finale è stata presa tenendo in considerazione che:
–  il dominio facebook.it era stato creato il 6 marzo 2006 ed era registrato a nome del sig. John Michael Preston;
–  il nome a dominio era stato sottoposto ad opposizione e che la stessa era stata registrata sul whois del Registro nel quale risultava il valore “CHALLENGED”
– digitando l’indirizzo http://www.facebook.it si giungeva ad un sito web, contenente link che reindirizzano ad altri siti che svolgono attività in diretta concorrenza con Facebook.
